Terms of Service

These terms govern the use of the ColdEmailServer service. By registering and using the service, you agree to them.

1. Service Provider

The service is operated by Brandrise s. r. o., Sokolovská 178/10, Košice, registration number 53 196 449 (hereinafter "Provider").

2. What the Service Offers

ColdEmailServer is a tool for building and managing email marketing infrastructure: servers, IP addresses, domains, mailboxes, and DNS setup. You manage the actual campaign delivery through your own tool.

3. Pricing and Payment

  • The service is provided on a monthly or annual fee according to the current pricing.
  • A one-time setup fee applies when you launch your first server.
  • Additional dedicated IP addresses are billed monthly according to the pricing.
  • The Provider is not a VAT payer; all stated prices are final.

4. Responsible Use

You agree to use the service in compliance with all applicable laws, especially email marketing rules (GDPR, electronic communications law, and similar regulations). Sending unsolicited mail to addresses without legal basis, fraudulent content, and any use that harms third parties or infrastructure reputation are prohibited. Violations may result in service suspension.

5. Deliverability

The Provider supplies infrastructure and tools to measure and improve it, but cannot guarantee a specific inbox delivery rate. Deliverability also depends on message content, volume, list quality, and recipient behavior, factors outside the Provider's control.

6. Suspension and Cancellation

You can cancel your subscription at the end of the billing period. If payment is not received, the service may be suspended after notice and a grace period. It resumes upon payment.

7. Liability

The Provider is responsible for service availability with reasonable care, but is not liable for damages caused by third-party provider outages, acts of God, or misuse by you.

8. Changes to Terms

The Provider may update these terms. Material changes will be communicated in advance. Continued use of the service after changes means you accept them.
